TICKET - SAYS: If you have any questions about your violation, please feel free to ask about what a conviction would mean for your record,  how we will address these charges and what other steps may need to be taken.  Below are the cases that can end your driving career.  A lot of people are finding out right now - the hard way - the truth of that assertion. We must, if humanly possible, prevent them from reaching your record.   I am not lying to you, or trying to scare you.  I am trying to WARN you of what can happen if you don't fight ALL of your moving violations.  It costs you very little to call and find out about this.

The DPS makes the following designations:

Major Violations  

  1. Having an alcohol concentration of 0.04 or greater while operating a CMV This is half what regular drivers are allowed.   All of these are 1 year suspensions 
  2. .Refusing to take an alcohol -(breath or blood - test as required by a State or jurisdiction   
  3.  BEing "under the influence" of alcohol as prescribed by State law.  Note, there is no numerical threshold for this
  4. Being under the influence of a controlled substance. 
  5. Leaving the scene of an accident.  
  6. Using the vehicle to commit a felony other than a felony described in number 9 of this table.
  7. Driving a CMV when, as a result of prior violations committed operating a CMV, the driver’s CDL is revoked, suspended, or canceled, or the driver is disqualified from operating a CMV. 
  8. Causing a fatality through the negligent operation of a CMV, including but not limited to the crimes of motor vehicle manslaughter, vehicular homicide ((murder) and criminally negligent homicide (unintentional murder).    All 1st degree Felonies = 5 - 99 + $10K fine.
  9. Using the vehicle in the commission of a felony involving manufacturing, distributing, or dispensing a controlled substance.

CONVICTIONS FOR THESE RESULT IN DISQUALIFICATION OR REVOCATION OF YOUR CDL FOR VARIOUS PERIODS, UP TO AN INCLUDING PERMANENTLY

Serious Violations [§522.003(25) Trans. Code] 

  1. Excessive Speeding, to wit: any speed (15 mph) or more above the posted speed limit. 
  2. Reckless Driving , to wit: driving a motor vehicle in willful or wanton disregard for the safety of persons or property.    You see, do you not, that "RD" has a lot more to do with what you were (or weren't) thinking when you committed the traffic offense, not what you actually did.
  3. Making improper or erratic lane changes.
  4. Following too closely.
  5. Violating State or local law relating to motor vehicle traffic control (other than a parking violation) arising in connection with a fatality accident.
  6. Driving a CMV without obtaining a CDL.
  7. Driving a CMV without a CDL in the driver's possession.
  8. Driving a CMV without the proper class of CDL and/or endorsements for the specific vehicle group being operated or for the passengers or type of cargo being transported.

TWO OF THESE WITHIN ANY 3 YEAR PERIOD RESULTS IN 60 DAY'S SUSPENSION.   THREE WITHIN 3 YEARS = 120 DAY'S SUSPENSION (and bankruptcy!)

Railroad Crossing CMV Violations [§522.081 Trans. Code]

  1. The driver  fails to slow down and check that tracks are clear of an approaching train.
  2. The driver fails to stop before reaching the crossing, if the tracks are not clear.   
  3. The driver is always required to stop - Hazmat, Buses - , but fails to stop before driving onto the crossing. 
  4. The driver fails  to  drive completely through the crossing without stopping.
  5. The driver fails to obey a traffic control device or the directions of a person authorized to direct traffic at the crossing. 
  6. The driver fails to complete a crossing because of insufficient undercarriage clearance (=high center's trailer.

CONVICTIONS FOR THESE RESULT IN 60 DAY SUSPENSIONS UPON FIRST OFFENSE CONVICTION.
